    The Committee on the Judiciary moves to amend the title of the bill as follows:

    H. B. 3044 –- “A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §61-14-1, §61-14-2, §61-14-3, §61-14-4, §61-14-5, §61-14-6, §61-14-7 and §61-14-8, all relating to civil forfeiture actions related to criminal activity; providing for the civil forfeiture of pertaining to property and assets used in, acquired by, or gained or flowing from various criminal fraudulent activities; providing definitions; property subject to forfeiture; procedures for seizure of forfeitable property; establishing rules and procedures for civil forfeiture proceedings involving crimes of fraud; seizure and disposition of forfeited property; notice requirements; care of forfeitable property in law-enforcement custody; proportionality requirements; innocent owner defenses; considerations associated with bona fide purchasers of property subject to forfeiture; lienholder considerations regarding forfeitable property; resale and disposition of forfeited property; application of proceeds and forfeiture funds; and providing exceptions.”
